Tattoo Artist Wins Court Case Over WWE 2K Reproducing Their Work In-Game

The tattoo artist who designed the tattoos for wrestler Randy Orton has won a lawsuit against Take-Two Interactive for recreating her artwork in the WWE 2K video game.

As reported by Reuterstattoo artist Katherine Alexander received $3,750 in damages after her designs were used without permission in WWE 2K16, 2K17, and 2K18.

WWE and Take-Two had claimed the artwork was recreated under fair use, but the jury voted in favor of Alexander. He said that he has set an important precedent in doing so.

Orton will appear as a playable character in WWE 2K. In other words, the full picture of Orton is reproduced in the game. This includes his body art, including tribal tattoos, skulls, Bible verses, doves and roses designed by Alexander, which prompted a lawsuit in 2018.

The incident sets an interesting precedent for sports simulation creators who regularly recreate tattooed athletes. Athletes themselves may consent to their in-game re-creation, but artwork with body tattoos may be considered to require additional permission.
